Terms & Conditions
1.1 The name of the Club is Stratford Oaks Golf Club (the Club).
The Club and Golf Course are owned by Toprapid Limited (the Proprietor).
2.1 The objectives of the Club are to promote and encourage the game of Golf. The Rules of Golf in force shall be those of the Royal & Ancient Golf Club of St. Andrews, together with any local rules published by the Proprietor in association with the relevant section committees.
3.1 The Club is a proprietary Club, the Proprietor and sole manager of which is Toprapid Ltd (“the Proprietor”). Hereinafter the term ‘the Proprietor’ shall mean the Proprietor or its appointed representative.
3.2 The Proprietor shall provide the Privilege Card Holder (hereinafter called “Members of the Club”) with a golf course and clubhouse plus all the facilities for the Club to achieve its objectives, and shall be solely responsible for all expenses incurred and for the engagement and payment of staff.
3.3 Members of the Club shall be subject to the payment of the annual fee for a Privilege Card as determined by the Proprietor. Payment of such fees for a Privilege Card shall entitle the holder to be a Member of the Club and to use the golf course and clubhouse facilities. The annual fee is non-refundable.
3.4 Payment of fees for a Privilege Card is on applying for Club Membership with annual renewal payments due by the 1st April each year.
3.5 Any Member whose fees remain unpaid after the 1st April shall be deemed to have resigned their Membership.
4.1 Categories and conditions of Membership, together with the associated fees, shall be as determined and published from time to time by the Proprietor.
4.2 The selection of Members shall be at the discretion of the Proprietor.
4.3 Each Member shall be issued with a Privilege Card. Privilege Cards shall in no circumstances be transferable, and their loss shall be reported forthwith to the Proprietor.
4.4 The Proprietor shall maintain a register of each Members name, address and telephone number, together with their membership terms and any other information relevant to their Club Membership. It shall be the responsibility of Members to advise the Director of Golf of any change in address and telephone number.
4.5 Members of the Club shall adhere to the booking system for tee times, which shall be published and amended from time to time by the Director of Golf.
5.1 The Proprietor shall from time to time determine and publish the appropriate green fee rates for visitors and Members guests.
5.2 Members shall be responsible for their guests at all times. A Member may introduce up to three guests per visit during the week at the reduced rate and only one guest per visit at weekends and bank holidays at the reduced rate.
5.3 Members shall be permitted to introduce the same playing guest at the reduced green fee on six times in any one Membership year. Members may introduce any number of non-playing guests to the clubhouse and its facilities.
6. Conduct of Members
6.1 Members shall at all times conduct themselves in accordance with the Rules of the Royal & Ancient Golf Club of St. Andrews and with these Rules, Terms and Conditions.
6.2 Rules concerning the standard of dress for Members, guests and visitors shall be determined and published from time to time by the Proprietor.
6.3 Any misconduct or breach of these Rules, Terms and Conditions, with the exception of those concerning Membership, the non-payment of fees and conduct of Employees of the Club shall be referred to the relevant Men’s or Ladies Section Committee, which shall investigate the circumstances and make a recommendation of suitable action to the Director of Golf as the Proprietors representative.
6.4 The Proprietor shall have the right to refuse admission to or cancel Membership if any Member shall, in the sole opinion of the Proprietor, cause nuisance or annoyance to other Club Members or to other users of the golf course. Before the Member is expelled the Proprietor shall enquire into the alleged misconduct of the Member, and the Member involved shall be given the opportunity to justify or explain his conduct. An expelled Member shall forfeit all entitlements of membership and shall not be entitled to any refund or fees paid.
7. Conduct of the Game
7.1 The Club recognises the Royal & Ancient Golf Club of St. Andrews as the ruling body of amateur golf, and agrees to abide by the Rules of Golf and Amateur Status as laid down and amended by the R & A.
7.2 The Club agrees to totally comply with the Regulations and Rules of the Standard Scratch Score and Handicapping Scheme 1983 and any amendments thereto or conditions imposed within the Scheme by the Council of National Golf Unions and comply with the Rules laid out in the current Ladies Golf Union Handbook.
7.3 The Club agrees to comply with Constitution and Rules of the English Golf Union, Ladies Golf Union and of the Warwickshire Golf Unions as a condition of affiliation to these bodies.
7.4 On behalf of the member the Proprietor agrees to collect and pay over all annual per capita subscriptions due to the English Golf Union, Ladies Golf Union and Warwickshire Golf Unions in respect of every male and female playing Member of whatever category.
7.5 The Proprietor shall exercise control over any Society or outside body using the Club in relation to amateur status and value of prizes.
7.6 The facilities of the course and part of the Clubhouse will be made available at reasonable intervals in accordance with normal County practice.
8.1 With the exception of guide dogs, animals shall not be permitted on the golf course and in the clubhouse unless prior permission has been given by the Proprietor.
9.1 Children who are not Junior Members shall be accompanied by a Member or Members guest, who shall be responsible for ensuring that children behave in a manner which will not cause any disturbance to the Club and its Members.
10. Hours of Opening
10.1 The Proprietor shall decide on the hours of opening of the golf course and clubhouse as deemed appropriate.
10.2 Members shall not be entitled to a refund or any other compensation in the event of closure of the golf course or clubhouse at any time.
11. Liability for Loss or Damage
11.1 The Proprietors liability for loss or damage to any Members property shall be strictly limited to damage or loss incurred as a result of negligence of the Proprietor or his staff. No liability shall be accepted by the Proprietor for property which is stored at the owners risk in lockers which may be provided by the Proprietor or his agents. Cars parked either in the Club car park or elsewhere on the Club premises shall be parked at the owners risk, and no liability whatsoever shall be accepted by the Proprietor in respect of them. The Proprietor shall not accept any liability for any accident which may occur to any Member either on the golf course, in the clubhouse or elsewhere within the grounds of the Club other than liability arising from negligence of the Proprietor his staff or agents. Any Member, Members Guest or visitor suffering an accident on the Club premises shall report the incident and circumstances to the Director of Golf or other responsible member of staff immediately after the incident. 12. Interpretation of and Amendment to Rules, Terms and Conditions (including Men‘s and Ladies Section Rules)
12.1 All Members of the Club shall be bound by these Rules, Terms and Conditions.
12.2 The Proprietor shall have the sole right to interpret, revoke, supplement or modify these Rules, Terms & Conditions , with the exception of the Men’s and Ladies Sections Rules which shall be interpreted by the Men’s Club Committee and Ladies Club Committee under the expert guidance of the Director of Golf, and which shall be revoked, supplemented or modified only by a resolution passed by a majority of Members present at an Annual General Meeting or Special General Meeting of the Men’s or Ladies Sections.
12.3 With regard to the Privilege Card Scheme the terminology “member” and “membership” used in the rules are used not in the sense of full membership rights in the management of the Club but as common terms used by golfers playing at both Proprietorial courses and full membership clubs.
